Market America's partner Sciona recently received notification from the New York State Department of Health that the Gene SNP DNA Screening Analysis is being considered a diagnostic test and only licensed M.D.'s are allowed to order the Gene SNP Screening Analysis in the state. As of Jan. 20, 2006 and until this issue has been fully resolved, Sciona will not process any Gene SNP analyses submitted by New York State residents except those ordered by a licensed M.D. Market America is working diligently with Sciona labs to resolve this issue. If you took the Gene SNP analysis prior to Jan. 20 and have received your report: You can continue to order your Custom Nutrition Formula. If you recently purchased a Gene SNP panel and live in New York State: You may still sell the Gene SNP kits to anyone who resides outside the state. Contact the Professional Services Center at (336) 478-4006, to request a refund. Or, you may return any unopened Gene SNP panels to Market America for a refund. If you are a licensed M.D. from New York State: The Gene SNP analysis will be processed and the report will be returned to you. If you or your customers reside in New York State and recently submitted your Gene SNP sample and questionnaire: Sciona will send a letter stating it will be unable to process your sample at this time and you will need to call the Professional Services Center at (336) 478-4006. Market America will supply the Distributor with a reimbursement for the product -- in order to process your reimbursement, you will need to send Market America a copy of your letter from Sciona. As a Distributor, you are responsible to reimburse your own customers. If you live in New York State but would like to continue purchasing the Gene SNP panels for customers in other states: You are free to continue to order and sell the panels and Custom Genetic Nutritional Formulas as usual. Since your customer does not live in the state of New York, there is no conflict. This announcement only applies to people with home addresses within the state of New York. We appreciate your patience and support in this matter.
