FTC Proposes New Business Opportunity Rule

On Wednesday, April 5, 2006, the Federal Trade Commission (FTC) issued its Notice of Proposed Rulemaking (NPR) dealing with business opportunities. The NPR is a follow-up to earlier revisions of the Federal Franchise Rule, and could very well create a new business opportunity regulatory regime.

As currently written, the proposed Rule would be detrimental to Market America, our Distributors and the direct selling community. It would do nothing to improve consumer protection.

In the near future, Market America will ask you to take action so that this burdensome regulation can be ammended. For more information about the rule, please visit Market America's Legislative Action Center. Log onto unfranchise.com and click on "Legislative Action" underneath "Other Services" in the left-hand navigation menu.

Special Message for WebCenter Owners

Some WebCenter Owners have indicated they are a confused as to whether their Web site customers can be considered for either the Market America Online Affiliate Store Program (Direct Partners, Super Stores or Endless Mall Stores) or the new MAPP/Regional IBV Program.

The answer is they can be considered possibly for both if they meet certain requirements. Let's take a look at each of the programs:

Market America Online Affiliate Store Program

A major requirement to be a Market America Online Affiliate Store is to offer a line of products and services that appeal to either a very broad audience or a significant segment of consumers. Products or services with a very limited audience of potential consumers or that mainly appeal to consumers living in a specific geographic location generally are not good candidates for our Online Affiliate Program. We also evaluate the financial stability of the applicant as well as the business' information processing, order processing/shipping capability, customer service availability and other factors.

If you have Web site customers you feel meet the above requirements, by all means, discuss the affiliate opportunity with them. We have an application form you can complete online. Log onto unfranchise.com and click on "Online Forms," then click "Electronic," then "Affiliate Submittal Form." Be sure to fill out the form completely, then review the policy and agreements before submitting. You may also share with your customer the information required on the application and they can e-mail the information directly to The New Partnerships Manager at partners@morebv.com. Please keep in mind that currently,  Distributor-owned sites are not eligible for the Online Affiliate Program nor are sites with products/services similar to Market America's products (cosmetics, anti-aging skin care, nutritional supplements, water filters, etc.).

If we find the store to be a good fit for our program we will negotiate a commission structure and make the store part of our Affiliate Program. You and your Preferred Customers would then be able to earn ongoing IBV or PC Points for shopping on your Web site customer's store.

MAPP/Regional IBV Program

MAPP/Local Stores are part of the Market America Regional IBV opportunity that makes it possible for Market America Distributors to earn IBV and their customers to earn Preferred Customer (PC) Points for shopping in "brick and mortar" retail businesses located in their neighborhood and surrounding areas.

Our MAPP/Local Stores base currently includes restaurants, dry cleaners, hair salons, doctor's offices and other fine retail establishments that have switched their credit card processing account to our MAPP Program Partner (iTransact) so we can track Market America transactions made in the MAPP Stores. A MAPP agrees to pay a commission on purchases made by Market America Distributors and Preferred Customers who pre-register credit cards with our Program Partner. The MAPP Merchant obtains exposure to the huge Market America Distributor and Preferred Customer base, the benefit of e-mail newsletters, PowerLine articles and other promotions.

If you have Web site customers who have "traditional" retail businesses, you should consider approaching them about the Regional IBV Program. Not only will you be opening a new window of opportunity for your customer, you will also earn 100 IBV if the customer switches their credit card processor to iTransact.

There are two things you should have in hand before you approach a business. The first item is a MAPP brochure (Code 9900, Cost $6, pack of 20) that you will give to the merchant, and the second is a merchant lead form. You may download the form by logging onto unfranchise.com, clicking on "Regional IBV," then clicking on "Lead Form" in the drop-down menu. You will also get the "Steps to Putting Businesses On the MAPP" Guideline when you download a lead form to learn how to get started and how to earn 100 IBV for your efforts. We suggest you review carefully these steps before you do anything else.

Explain the benefits of becoming a MAPP Merchant (covered in the brochure), the requirements for becoming a MAPP merchant and ask for their permission to submit the lead form to iTransact. From that point on, Market America will attempting to convince the merchant to join the MAPP Program.

We strongly encourage WebCenter Owners to take advantage of these two opportunities to help qualified Web site customers to increase their store exposure, potential sales and profitability through an Affiliate Partner Program with Market America.

MAPP Reminder: Pre-Register Credit Cards to Earn IBV

Market America has begun to receive calls and messages from many of you who have not received IBV for purchases made through MAPP Merchants.

In almost every instance, the problem stems from failing to pre-register the credit cards you used to pay for the purchase before making the purchase. You must pre-register your credit cards (up to five maximum) to receive IBV for shopping MAPP Merchants. If you do not pre-register your cards, we are unable to track your purchases and, therefore, we are unable to award you any IBV for shopping in the store. You even have to pre-register your Market America credit card. If you do not, you will only receive the one percent IBV for using the card and not the additional IBV for shopping in a MAPP merchant.

Log onto unfranchise.com and register up to five major credit cards as follows:

1. Click "Regional IBV" in the left-hand navigation menu.
2. Select the "Register Credit Card" option from the drop-down menu.
3. List up to five major credit cards you will use with MAPP merchants. Be sure to include your Market America credit card to earn an extra one percent IBV on purchases.
4. Click "Register."

Then, click on "Shop Local Stores" to find MAPP merchants where you live, work and travel. Your Preferred Customers will soon be able to pre-register up to five credit cards on your portal to earn PC Points (and you earn 50 percent of the IBV generated) for their purchases through MAPP Merchants and other Market America Partner Stores. Watch for an upcoming announcement regarding the New Preferred Customer Incentive to shop in our Partner Stores.
